A debt collector is contacting me. What are my rights?

Common question · Debt Recovery · New Zealand · 23 October 2026

General information from Lawmateanz

Debt collectors in New Zealand must not mislead you, harass you, or use unfair pressure. The Fair Trading Act 1986 and the Credit Contracts and Consumer Finance Act 2003 protect consumers.

You're entitled to ask for details of the debt, including who it's owed to, how much, and how it's made up. If you think it's wrong, or too old to be enforced, say so in writing.

Most debts can't be recovered through the courts after six years, though there are exceptions.

If you can't pay, contact the collector and offer a realistic repayment plan. Free financial mentors through MoneyTalks (0800 345 123) can help you negotiate.

If you have a complaint, the creditor's dispute resolution scheme, the Commerce Commission and Community Law Centres can help.
