Can Oranga Tamariki take my children?

Common question · Child Protection Law · New Zealand · 23 October 2026

General information from Lawmateanz

In New Zealand, a child can only be removed from their parents' care in limited circumstances, such as with a Family Court order or, in urgent situations, under a warrant or emergency powers when a child is at serious risk.

Usually, Oranga Tamariki must work with the family first, including through a family group conference, unless the situation is urgent.

If a child is removed, the matter goes before the Family Court quickly, and you have the right to be heard and to legal representation. Legal aid is often available.
