How do I get a protection order in New Zealand?

Common question · Family Violence & Protection Orders · New Zealand · 23 October 2026

General information from Lawmateanz

If you're experiencing family violence, you can apply to the Family Court for a protection order under the Family Violence Act 2018. Family violence includes physical, sexual and psychological abuse, including threats, intimidation and controlling behaviour.

There's no court fee. If you need urgent protection, your application can be made 'without notice', meaning the court can make a temporary order before the other person is told.

A protection order makes it an offence for the other person to be violent towards you, or to contact or come near you in ways the order prohibits. It can also cover your children.

Legal aid is often available, and a lawyer usually helps prepare the application and supporting statement.

If you're in immediate danger, call 111. Women's Refuge (0800 733 843), Shine (0508 744 633) and Community Law Centres can help.
