Is there a cooling-off period when buying a house in Australia?

Common question · Property Law (Conveyancing) · Australia · 23 October 2026

General information from Lawmateanz

Most states and territories give buyers of residential property a short cooling-off period after signing a contract, usually a few business days. The length differs by state, and Western Australia generally doesn't have one.

Cooling-off rights usually don't apply to purchases at auction, and you may lose a small part of your deposit if you withdraw during the cooling-off period.

Before signing, have a conveyancer or lawyer review the contract, and arrange finance approval, building and pest inspections.

Your state's fair trading or consumer affairs agency has a buyer's guide.
