My employer has gone into liquidation. Will I get paid?
Common question · Insolvency · New Zealand · 23 October 2026
General information from Lawmateanz
When a company goes into liquidation in New Zealand, a liquidator is appointed to sell its assets and pay creditors in a set order.
Employees are preferential creditors for unpaid wages, holiday pay and certain other entitlements, up to a set limit. That means they're paid before most unsecured creditors, but after some secured creditors and liquidation costs.
Contact the liquidator to lodge a claim for what you're owed. Their details are on the Companies Office website.
If there isn't enough money, you may not be paid in full. Employment New Zealand and your union can help.
