What legal terms does my online business need?

Common question · Technology & IT Law · New Zealand · 23 October 2026

General information from Lawmateanz

If you sell online in New Zealand, consumer law still applies. The Consumer Guarantees Act and Fair Trading Act protect customers, and you can't contract out of the Consumer Guarantees Act with consumers.

Your website should have clear terms of sale, including prices, delivery, returns and how complaints are handled, plus a privacy policy that meets the Privacy Act 2020.

Online traders must also provide certain information, such as their name and contact details, and be clear about total prices including GST and delivery.

If you send marketing emails or texts, you need consent and an unsubscribe option under the Unsolicited Electronic Messages Act 2007.
