Do I need a lawyer for my first court appearance?
Common question · Criminal Law · New Zealand · 23 October 2026
General information from Lawmateanz
You don't have to have your own lawyer for a first appearance in a New Zealand criminal court, but it's strongly recommended that you speak to one.
Every District Court has a duty lawyer service. A duty lawyer is free and can give you advice on the day, help with bail, and in some cases enter a plea or ask for an adjournment.
You may also be able to get legal aid, which pays for a lawyer for your case. Whether you qualify depends on your income and how serious the charge is. You can apply at court or through the Ministry of Justice.
Think carefully before pleading guilty at your first appearance, and get advice first. A conviction can affect your job, travel and future.
The Ministry of Justice website explains what to expect at court, and Community Law Centres can help too.
