Who gets my super when I die?

Common question · Superannuation Disputes · Australia · 23 October 2026

General information from Lawmateanz

Super isn't automatically part of your estate in Australia. The fund trustee usually decides who receives it, unless you've made a valid binding death benefit nomination.

Dependants, such as a spouse or children, and your estate can receive it.

If you disagree with a trustee's decision, you may be able to complain to AFCA, within strict time limits.

Review your nominations regularly.
