Who is responsible for repairs in a unit title building?

Common question · Body Corporate & Unit Titles Law · New Zealand · 23 October 2026

General information from Lawmateanz

In New Zealand, it depends on whether the repair relates to your unit, common property, or building elements and infrastructure.

The body corporate is generally responsible for common property, and for building elements like roofs, external walls and shared pipes that serve more than one unit, even if they're within a unit's boundary.

Owners are generally responsible for repairs within their own unit that only affect that unit.

The unit plan and the body corporate rules help determine who's responsible. If you disagree, the Tenancy Tribunal can hear many unit title disputes.
