Am I entitled to redundancy pay in Australia?

Common question · Employment Law · Australia · 23 October 2026

General information from Lawmateanz

Under the National Employment Standards, most employees made redundant after at least one year of continuous service are entitled to redundancy pay, based on a scale that increases with years of service.

Employees of small businesses with fewer than 15 employees generally aren't entitled to it under the National Employment Standards, though an award or agreement may provide it.

You're also entitled to notice (or pay instead of notice) and payment of unused annual leave.

The Fair Work Ombudsman's website has a redundancy pay calculator and free advice line.
