I think I've been underpaid. How do I get my wages back?

Common question · Employment Law · Australia · 23 October 2026

General information from Lawmateanz

In Australia, minimum pay and entitlements are set by the National Employment Standards and awards or enterprise agreements. Check your pay against the Fair Work Ombudsman's pay calculator.

Raise it with your employer in writing first. If it isn't resolved, the Fair Work Ombudsman can help, and you can make a small claim in a local or magistrates court.

Most claims for unpaid wages must be made within six years. Deliberate underpayment can now be a criminal offence.

Unions, community legal centres and the Fair Work Ombudsman (13 13 94) can help.
